CONTRACTUAL TERMS AND OTHER IMPORTANT NOTICES

PASSENGERS ON A JOURNEY WITH A FINAL DESTINATION OR WITH A STOP IN A COUNTRY OTHER THAN THE COUNTRY OF DEPARTURE ARE INFORMED THAT THE INTERNATIONAL TREATIES KNOWN AS THE MONTREAL CONVENTION, OR ITS PREDECESSORS, THE WARSAW CONVENTION, INCLUDING THEIR AMENDMENTS (THE WARSAW CONVENTION SYSTEM ), MAY APPLY TO THE ENTIRE RACE, INCLUDING A PART OF IT IN A SPECIFIC COUNTRY. FOR SUCH PASSENGERS, THE APPLICABLE TREATY, INCLUDING THE SPECIAL CONTRACTS OF CARRIAGE INCLUDED IN ANY APPLICABLE FARES, GOVERN AND MAY LIMIT CARRIER'S LIABILITY.

NOTICE of Limitation of Liability

The Montreal Convention or the Warsaw Convention system may apply to your journey and these Conventions govern and may limit the liability of air carriers for personal injury or death, for loss or damage to baggage, and for delay.

Where the Montreal Convention applies, liability is limited as follows:

1. There are no financial limits for bodily injury or death.

2. Regarding the destruction, loss, damage or delay of baggage, 1,131 Special Drawing Rights (approximately 1,200 Euros; 1,800 USD) per passenger are granted in most cases.

3. For damages caused by the delay of your flight, 4,694 Special Drawing Rights (approximately 5,000 euros; 7,500 USD) per passenger are granted in most cases.

EC Regulation no. 889/2002 requires carriers from the European Community to apply the provisions of the Montreal Convention and related limitations regarding the liability of carriers for all passenger and baggage transport activities by air. Many non-EU carriers have chosen to apply the same convention to the carriage of passengers and their baggage.

Where the Warsaw Convention system applies, the following limits of liability may apply:

1. 16,600 Special Drawing Rights (approx. Euro 20,000; USD 20,000) for personal injury or death if the Hague Convention Protocol applies, or 8,300 Special Drawing Rights (approx. Euro 10,000; USD 10,000) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits entirely, and US rules require that, for trips to, from, or with a fixed stop in the United States, the limit be no less than $75,000.

2. 17 Special Drawing Rights (approx. 20 Euro; 20 USD) per kg for lost or damaged or delayed checked baggage, and 332 Special Drawing Rights (approx. 400 Euro; 400 USD) for hand luggage.

3. The carrier can also be held liable for damages caused by the delay.

You can obtain more information from the carrier regarding the limits applicable to your journey. If your journey involves carriage with different carriers, you should contact each individual carrier for information about the applicable limits of liability.
Regardless of the Convention applicable to your journey, you may benefit from a higher limit of liability in the event of loss, damage or delay of baggage by submitting a special declaration of the value of baggage at check-in and paying all applicable additional fees. Otherwise, if the value of your Baggage exceeds the applicable liability limit, you should insure your Baggage in full before you travel.
Time limit for legal action: Any legal action to claim damages must be commenced within two years from the date of arrival of the aircraft, or from the date on which the aircraft should have arrived. Baggage complaints: a written notification must be sent to the carrier within 7 days of receiving the hold baggage in case of damage and in case of delay, within 21 days from the date on which it was made available to the passenger.
Notice of Contractual Terms Incorporated by Reference

1. Your contract of carriage with the carrier providing you with air carriage, international, domestic or a domestic part of an international journey is the subject of this notice; any notification or receipt of the carrier; and the carrier's individual conditions (Terms), related regulations, rules and policies (Regulations) and all applicable rates.
2.  If your transport is carried out by several carriers, different Conditions, Regulations and all applicable tariffs may apply for each individual carrier.
3.  The Conditions, Regulations and all applicable rates of each carrier are, according to this notice, incorporated by reference into and made a part of your contract of carriage.

4. The conditions may include, but are not limited to:

  • Conditions and limits of liability of the carrier for bodily injury or death of passengers.
  • Conditions and limits of the carrier's liability for loss, damage or delay of goods and baggage, including fragile or perishable goods.
  • The applicable rules for declaring a higher baggage value and paying additional fees.
  • Application of the Carrier's Conditions and limitations of liability to actions taken by the carrier's agents, officials and representatives, including any person providing equipment or services to the carrier.
  • Restrictions on complaints, including deadlines by which passengers must file complaints or initiate lawsuits against the carrier.
  • Rules regarding reconfirmations or reservations; check-in times; the use, duration and validity of air transport services; and the carrier's right to refuse carriage.
  • Carrier's rights and carrier's liability limits for delay or failure to provide a service, including schedule changes, substitution of alternate carriers or aircraft(s) and route reconfiguration, and, if required by applicable law, carrier's obligation to notify passengers of carrier's identity or the substituted aircraft(s).
  • The carrier's right to refuse carriage to passengers who do not comply with the applicable legislation or who do not present all the necessary travel documents.

5. You can get more information about your contract of carriage and find out how to obtain a copy of it at the points of sale of transport tickets. Many carriers have included this information on their websites as well. If required by applicable law, you have the right to inspect the full text of your contract of carriage at the airport and at the carrier's points of sale, and, upon request, you have the right to receive a copy of it free of charge by post or other courier service , from each individual carrier.
6. If a carrier sells air transportation services or accepts baggage for carriage indicating carriage with another carrier, it does so only as an agent of the other carrier.

SOME STATES MAY REQUIRE YOUR CARRIER TO PROVIDE INFORMATION ABOUT OR ALLOW ACCESS TO PASSENGER DATA.
REFUSED BOARDING: Flights can be overbooked and there is a very small probability that the seat will not be available on the flight even if you have a confirmed reservation. In most situations, if you are involuntarily denied boarding, you are entitled to compensation. If required by applicable law, the carrier must seek consent before denying involuntary boarding to a person. Contact the carrier for complete Denied Boarding Compensation (DBC) payment rules and information about the carrier's boarding priorities.
BAGGAGE: A higher value can be declared for certain types of items. Carriers may apply special rules for fragile, valuable or perishable items. Check with your carrier. Checked Baggage: Carriers may grant a free allowance for checked baggage, which is determined by the carrier and may depend on class and/or route. Carriers may apply additional fees for checked baggage that exceed the allowance granted by them. Check with the carrier. Hand Baggage: Carriers may grant a free allowance for hand baggage, which is set by the carrier and may depend on the class, route and/or type of aircraft. Minimizing hand luggage is recommended. Check with the carrier. If several carriers insure your trip, each carrier may apply different rules for baggage (both checked and carry-on). SPECIAL LIMITATIONS ON BAGGAGE LIABILITY FOR TRAVEL IN THE UNITED STATES: For domestic travel performed entirely between locations within the United States, federal law requires that any carrier's limit of liability for baggage be at least $3,300.00 per passenger, or the lesser of current mandate 14 CFR 254.5.
CHECK-IN TIMES. The time indicated on the ticket/receipt is the departure time of the aircraft. The flight departure time is not the same as the time you have to check-in or the time you have to be present for boarding. Your carrier may refuse your shipment if you are late. Check-in times, announced by the carrier, are the latest times at which passengers can be accepted for the ride; the boarding times announced by your carrier are the latest times at which passengers must present themselves for boarding.

DANGEROUS GOODS (HAZARDOUS MATERIALS). For safety reasons, dangerous goods must not be packed in checked baggage or hand baggage unless this has been expressly permitted. Dangerous goods include, but are not limited to: compressed gases, corrosive substances, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and bags with installed alarm systems. Other restrictions may apply for safety reasons. Check with your carrier.
